Dear Footloose Friends,

Subject: Trapping Advisory Committee to meet August 28 and 29

Next Tuesday and Wednesday the Trapping Advisory Committee will meet in
Butte, and the public is welcome to attend, and to comment at noon both
days. See FWP notice below. The committee is 60% trappers, and 40%
non-trappers, based on the vote on I-177 in 2016, not on the number of
trappers v. the number of non-trappers in the state.  Nevertheless, the
ratio is better than in the past.  It is critically important for
non-trappers to show up one day at these meetings; though hard to do for
those of us with jobs.  Please spread the word, show up for even a couple
of hours, and help get people to this one in Butte.  Thanks!  We need to
keep the pressure on to show the indefensible destruction of traps on our
public lands.

*Issues to address:*
1. *Regulations need to be re-written*; they are confusing and
contradictory.  (See below for details)*

2. *Urge mandatory 24-hour trap-check t*o reduce injury and fatality of
non-target wildlife and companion animals and to reduce suffering.

3. Put a* moratorium on beaver trapping on public lands,* with exceptions
for protection of property and roads from flooding.  Reintroduce beaver
from low lands to high country.  This will mitigate drought and fire.

4. *Restrict predator and non-game trapping* for animals such as coyote,
fox, badger, to a season, with license required and reports required for
all animals taken, including non-target.  At this time, there are no
regulations at all.  That means anyone can claim they are trapping for
coyotes while catching endangered species, fur bearers, or pets.  No
records are kept, no reporting required.  This undermines all other
regulations and efforts to determine species' populations.

5. Put *signage* up in areas that are actively being trapped.  Hunters wear
orange and hunting season is well publicized, but trappers give no warning
to the public about dangerous traps hidden on public lands.  Why not?  In
the past, there was no signage because trappers stole each others' traps.
Now they say non-trappers will steal their traps.  However, it is illegal
to tamper with a trap.
Set guns, which are just like traps, have been illegal for decades.  Even
leaving a fishing rod unattended with a hook on it is illegal.  Yet traps
are legal to set almost anywhere on public lands, and are far more harmful
than a fish hook.  More people than ever are recreating on our public
lands.  It's time trappers take responsibility for their actions as hunters
and anglers do.

This booklet contains regs for trapping 1) furbearers and 2) predators and
non-game wildlife.  Notably, regs for wolf trapping are published
separately and are typically different regs.



*》**It is unlawful to remove your dog, your cat, your child, yourself, a
protected species (e.g. raptor), or a game animal (e.g. deer) from a trap
without the trapper's permission - even if the trap is illegally set.  *

Because to do so would, at minimum, disturb the trap.

"It is unlawful destroy, disturb or remove *any* trap, snare or trapped
wildlife ... without permission of the owner of the trap or snare...."
(page 3)

The regs make no distinction between legally and illegally set traps.  As
the reg reads, disturbing ANY trap is unlawful.



*》Setbacks from public land recreation areas, campgrounds, fishing access
sites, designated trails and trail heads DO NOT apply to traps that are set
in/ on water.  *

Thus, there are no setbacks for traps that are ("originally") placed in the
water.  (page 5)

"Water sets" are defined as "any trap originally set in or on a body of
water." These traps "include traps on floats in the water and those that
are set with a minimum of one-third of the trap submerged."  (page 3)



*》Conibears that are 7" x 7" or larger that are (originally) set in water
DO NOT require placement within a container (that would minimize non-target
"capture").  Nor do these lethal water traps require a setback *(see
above).

Think about trails that follow creeks, people recreating at fishing access
sites and lakes, etc.

Only "ground sets using 7 x 7 inches and larger body-gripping traps..."
require the specific containers.  (page 5)

"Ground sets" do not include traps originally set in/ on water.  (pages 2-3)



*》Those who are trapping predators and/ or non-game are NOT required to
report to FWP the "incidental" trapping of dogs. *

The requirement to report trapped dogs to FWP only applies to those
trapping furbearers (and wolves, if I correctly remember).  (see:
non-target species under general trapping regs, page 4; and, captures of
domestic dogs under furbearer regs, page 5)

Predator species = *coyote**, weasel, striped and spotted skunks

Non-game species include red fox, badger and raccoon.

* canid scent lures have been shown to attract dogs, coyotes, and wolves

*This lack of reporting trapped dogs by those who are trapping predators
could be a key reason for the low numbers of trapped dogs as far as FWP is
concerned.*

 There are more issues, especially concerning the published details about
the trapper education course suddenly canceled.

Trapping Advisory Committee to meet August 28 and 29

The Montana Trapping Advisory Committee will hold its second meeting Aug.
28 and 29 in Butte at the Emergency Services Building, 3615 Wynne Ave.

Montana Fish, Wildlife & Parks assembled this citizens’ committee to
provide recommendations that ensure population viability of trapped
species, the humane treatment of animals and the minimization of social
conflict. The committee represents the spectrum of opinions on trapping.

During the meeting, members will affirm the committee’s charter, clarify
roles in the process, review the collaborative process and timeline,
continue learning about trapping in Montana, draft guiding principles and
begin work on addressing questions the committee previously identified as
most important.

The committee will have two to three more professionally facilitated
meetings over the next six months and will present recommendations to FWP
by March 30. FWP staff are not members of the committee but will provide
information and technical assistance.

The meeting is open to the public. The committee will hear public comment
at noon on both days.
